All You Need to Know About Notarized Power of Attorney

A notarized power of attorney is essential in Dubai to ensure its validity and enforceability. Public notaries in Dubai provide online notarization services to people who require them. Remote notaries have proclaimed public services to allow individuals to conduct their transactions online rather than visiting the notary public in person. There are few guidelines regarding the signing and notarizing POA papers in front of Dubai’s private notaries. Anybody from anywhere in the world can now make use of the UAE’s online POA service.

Basics I Should Know About POA Online Dubai

A power of attorney is a powerful document that allows someone to make decisions and take actions on behalf of the principal when they are unable to do so themselves. The principal is the person granting the authority, while the individual or organization receiving the authority is referred to as the agent or attorney-in-fact.

Choosing an Agent

When choosing an agent, it is important to consider the following:

  • The agent should be a mentally competent adult who is trustworthy and capable of carrying out the responsibilities.
  • It is advisable to choose someone who understands the wishes of the principal and is willing to act in their best interest.
  • The agent should be available and willing to take on the responsibilities outlined in the POA.

Different Kinds of POA in Dubai

  1. General Power of Attorney: A general POA grants broad powers to an agent and allows them to make legal or financial decisions, enter contracts, and handle various matters on behalf of the principal. A general POA is suitable when the principal wants to grant extensive powers to the agent.
  1. Property Power of Attorney: A property POA is used for real estate transactions which include buying, selling, or renting a property. It allows the agent to act on behalf of the principal in matters related to real estate acquisition.
  1. Vehicle Power of Attorney: A vehicle POA is used when the principal wants to authorize the agent to handle matters related to vehicles, such as purchasing, selling, or registering a vehicle.
  1. Company Power of Attorney: A company POA is used when the principal wants to delegate authority to another person to manage the affairs of a company. This can include making decisions, signing contracts, and representing the company in various matters.

Documents That Can Be Notarized Online

In Dubai, certain documents can be notarized online. Here are some examples:

  • Notarization of power of attorney
  • Notarization of legal notice
  • Acknowledgments
  • Local service agent agreement notarizations
  • Memorandum of associations/articles of association addendums there to w.r.t. civil companies notarization

Preferred Language For Notarization

It’s important to note that the documents to be notarized must be in Arabic or authenticated dual-format English and Arabic. Additionally, some documents related to commercial companies may need to be notarized by private notaries in collaboration with the Dubai Economic Department.

Validity and Duration of Power of Attorney

A Power of Attorney in Dubai must be made by keeping the laws in the UAE in mind. It has a fixed time duration and is valid as long as the specified transaction or activity is carried out. Generally, a POA in Dubai is valid for two years and must be renewed after that period. If the POA needs to be revoked, a notification must be sent to the office that issued the document initially.

It’s important to note that Dubai and the UAE do not recognize a lasting power of attorney, meaning that such a document will be canceled once the executor has died. Additionally, Dubai does not allow for the signing of an irrevocable power of attorney.

Signing and Use of Power of Attorney

If you reside in the UAE, a Dubai power of attorney can be signed before a POA notary public in various locations, including Dubai, Abu Dhabi, Sharjah, Ras Al Khaimah, Fujairah, Ajman, or Umm Al Quwain. A power of attorney remains valid throughout the UAE regardless of the place of signing within the UAE.

For people who reside outside the UAE, a UAE power of attorney can be signed before a POA notary public in the country of their residence. However, it will require attestations by the government departments of both the country of residence and the United Arab Emirates before it can be used in the UAE.
